PITTSBURGH, Pa. - Starling Marte swung so miserably at the first two sliders he saw from Arizona Diamondbacks closer Addison Reed in the ninth inning that the Pittsburgh left fielder knew more were on the way. So he stepped out of the batters box, took a deep breath and waited. "I was struggling the first two pitches but I was thinking about the pitch I want," Marte said. "He threw me a slider and it was a good chance to hit the ball." Was it ever. Marte turned an 81 mph slider over the middle of the plate into a game-tying, two-run double and then scored on pinch-hitter Ike Davis single two batters later as the Pirates rallied for a 3-2 win Tuesday night. "Every time were up to bat theres a chance we do something," Davis said. "Its hard to shut us down for nine. Weve done it a lot this year ... anything is possible with us." The Pirates were shut down for eight innings by Arizona starter Wade Miley before rallying in the ninth. Neil Walker and pinch-hitter Gregory Polanco started the inning with singles against Miley. One batter later, Marte turned an 0-2 count into a tie game. "He got a ball that he could get a barrel on," Pirates manager Clint Hurdle said. "He slowed it down and put a good swing on it and hit it to the big part of the ballpark." Andrew McCutchen was intentionally walked and Davis hit a broken-bat single to right, scoring Marte easily as the Pirates won for the fourth time in five games. Ernesto Frieri (1-3) earned his first win with the Pirates after working a scoreless ninth. The abrupt ending ruined an otherwise stellar outing for the struggling Miley, who is winless since May 10. The left-hander retired the first 14 batters he faced and allowed four hits in eight-plus innings, striking out 10. Despite the slender lead, Arizona manager Kirk Gibson didnt hesitate to send Miley back out for the ninth in search of his first career shutout. Things changed quickly, however, when Walker and Polanco reached. "I didnt make good pitches," Miley said. "Actually, the pitch to Walker was a good one, a slider down and in, but I hung a pitch to Polanco. I was making pitches all night long but I didnt make them when I needed to." Until the late miscues, it appeared Miley was on his way to his first victory in nine starts. Miguel Montero and Aaron Hill produced consecutive RBI singles in the fifth off Pirates starter Jeff Locke. Paul Goldschmidt went 2 for 4 with a run for the Diamondbacks, who fell to 27-2 when leading after eight innings. "I want to be the guy out there with the game on the line," Reed said after blowing his fourth save. "Sometimes it doesnt go the way I want or my teammates want it to." Locke lacked Mileys crispness but allowed only two runs over eight innings, yielding eight hits while walking one and striking out three. The Diamondbacks stranded six runners in the first four innings and were on their way to doing it again in the fifth before catching a break thanks to some sloppy defence by the Pirates. Goldschmidt singled with two outs and was attempting to steal second when the Pirates sniffed it out. Locke threw to Gaby Sanchez at first to start the rundown, but the burly Goldschmidt was safe at second when Sanchezs throw to shortstop Jordy Mercer sailed into left field. Montero followed with a single that brought Goldschmidt home, and Montero scored moments later on Hills flare to shallow right. Given some room to work with, Miley didnt let it go to waste. He struck out the side in the seventh and had little trouble in the eighth. Arizona nearly extended its lead to 3-0 in the ninth, only to have Gerardo Parra thrown out at home trying to score on a single to right by Ender Inciarte. Less than 15 minutes later, the Pirates were celebrating their second win in 35 games when trailing after eight innings. TALLAHASSEE, Fla. -- Florida State quarterback and Heisman hopeful Jameis Winston will not face any charges in a sexual assault case, mostly because there were too many gaps in his accusers story, a prosecutor said Thursday. State Attorney Willie Meggs said the womans memory lapses about the events last December were problematic and there was not enough evidence to win a conviction. "Its not inconsistencies, its lack of memory most of the time," Meggs said. The woman told police she had been drinking at a bar with friends and went home with a man she didnt know. She said she the alleged assault took place at an off-campus apartment, but she couldnt remember where it was. A month later, she identified her alleged attacker as the quarterback. Winstons attorney said the sex was consensual. The quarterback said in a statement he was relieved. "Its been difficult to stay silent through this process, but I never lost faith in the truth and in who I am," Winston said. The alleged assault happened long before Winston became a star on the national stage. Reports about an investigation didnt surface in the public until last month, as the redshirt freshman was well into a remarkable season with Florida State. Winston, 19, has led the Seminoles to a No. 1 ranking and a shot at a national championship if they defeat Duke on Saturday in the ACC title game. As for the Heisman, many voters were waiting to see whether he would be charged before casting their ballot. The deadline is Monday and Winston is considered a leading contender for the trophy for the nations top player. It will be awarded Dec. 14. The accusers family has been sharply critical of the Tallahassee Police Department, accusing the agency of delaying the investigation and discouraging her from going forward with the case because of the public attention it would receive. "The victim has grave concerns that her experience, as it unfolded in the public eye and through social media, will discourage other victims of rape from coming forward and reporting," according to a statement from the accuser and her family. The Associated Press does not identify alleged victims of sexual assault. On Thursday, specific details of the alleged assault were released. The woman told police she and friends were drinking at Potbellys and said she remembered getting into a cab with a man she didnt know. At the apartment, she said she tried to fight the man off, but he wouldnt stop. At some point, she said another man came into the room and told her attacker to stop, but he didnt. Her next memory was of the suspect dressing her, putting her on a scooter and dropping her off at a campus intersection. Once she got back to her room, she called police and later went to the hospital. Police said they opened an investigation and were collecting evidence when they were told in February she didnt want to pursue the charges. The womans attornney has denied she wanted to drop the investigation.dddddddddddd Winston refused to be interviewed by police and has not answered questions from the media. Two of his teammates backed his story in statements they gave last month to an investigator for the quarterbacks attorney, Timothy Jansen. The statements were part of an investigative file released Thursday. Teammates Christopher Casher and Ronald Darby said they were at Potbellys with Winston when the accuser struck up a conversation with the quarterback and got into the cab with the three men. Once at the apartment, the teammates said they peeked through Winstons bedroom door and saw the woman having sex with the quarterback. At one point, Casher said he "busted into the room to embarrass Jameis" and the girl yelled at him to "get out." In a later interview with police, Casher changed this part of his story, saying he went into the room because he hoped the woman would also have sex with him, something he said had happened in the past when he and Winston brought a woman to the apartment. Casher left the room and was not accused of having sex with the woman, and no other women have made accusations against Casher or Darby. Meggs office took over the case last month. Investigators interviewed the accuser, other witnesses and collected evidence before the prosecutor made his decision. He said the womans blood-alcohol content at the hospital was .04 and investigators estimated it to be about .10 at the time of the incident, based on the amount of time that had passed. The legal limit to drive in Florida is .08. They also took DNA from Winston and matched it to DNA collected from the womans underwear. DNA on her shorts matched her boyfriend at the time. The accusers family has said they pushed police to take a DNA sample from Winston earlier in the investigation, only to be told by a police detective that it would alert Winston and make the case public. The family said the accusers attorney, Patricia Carroll, was warned by police that Tallahassee is a "big football town, and the victim needs to think long and hard before proceeding against him because she will be raked over the coals and her life will be made miserable." Tallahassee police have defended their handling of the case. The alleged victim was an FSU student, but she left school last month as media reports of the case surfaced. Meggs said when his office spoke with the woman last month, she wanted the case to move forward. At a restaurant on campus, students high-fived one another and did the Seminoles chant and tomahawk chop when Meggs said no charges would be filed. "Its been a tough couple weeks," said Justin Savage, a 21-year-old senior sports management major from Fort Walton Beach. "Im just so grateful. Hes just so lovable a guy. You can see him on campus and hell talk to you, it doesnt matter who you are."
